On December 13, Lam Dong Provincial People's Committee announced that Chairman Tran Van Hiep had just signed a decision stipulating conditions, criteria, scale, and ratios for separating into independent projects in the province.
This Decision stipulates the conditions, criteria, scale, and ratio for separating the land area allocated by the State for management; agricultural land used for public purposes; land that the land user does not have the right to transfer, lease, or contribute capital using land use rights according to the provisions of the law on land and does not have assets attached to the land, and this land area is located interspersed with the land area that has received transfer, leased land use rights, or received capital contribution using land use rights, which is separated into an independent project in the area.
Lam Dong has new regulations on conditions and scale for separating into independent projects.
The use of land to carry out projects and production and business works is not subject to the State's land recovery as prescribed in Articles 61 and 62 of the Land Law.
The subjects of application are competent state management agencies on land; investors and organizations and individuals using land in the province related to investment activities.
Regarding the conditions and criteria for the land to be separated into an independent project, first of all, it must be consistent with the detailed construction planning and land use planning at the district level; including one or more plots of land that must be contiguous in the area and contiguous. There must be at least one side adjacent to an existing road or a planned road, the minimum road surface width is 7 m; the size of the edge of the land plot adjacent to the intersection road is ≥ 25 m; the depth of the land plot from the edge of the road boundary or the edge of the existing road (for roads without a road boundary) is ≥ 25 m.
For districts, land area after separation into independent projects ≥ 1,500 m2
For the group of projects using land for commercial and service purposes in Da Lat City and Bao Loc City, the land area after being separated into independent projects must be ≥ 1,000 m2 , and must account for ≥ 20% of the total area of land proposed for project implementation; for the districts, the land area after being separated into independent projects must be ≥ 1,500 m2 , and must account for ≥ 30%.
Meanwhile, for the group of projects using land for non-commercial and service purposes, the land area after being separated into independent projects must be ≥ 1,500 m2 , and must account for ≥ 30% of the total area of land proposed for project implementation...
