Human kidney trafficker sentenced to 9 years in prison

On November 19, the People's Court of Thua Thien - Hue province opened the first instance trial of the case of buying and selling human body parts against defendant Nguyen Van Ninh (born in 1988, residing in My Xuyen district, Soc Trang province).

According to the indictment, because he had sold his kidney at Hue Central Hospital, Ninh knew the process and procedures for making kidney transplant applications and the patients' need to buy kidneys. Around the end of 2020, Ninh went to the Nephrology Department of Hue Central Hospital to look for patients in need of kidney transplants and kidney sellers to buy and sell kidneys for illegal profits.

Ninh and the kidney buyer agreed with each other through a "Health Service Provision Contract" with prices ranging from 700 million VND to 1 billion VND per kidney, depending on the time.

The contract stipulates terms such as: medical examination, treatment, hospital procedures, tests, surgery and other costs until the kidney transplant is successful.

The parties agreed to pay in 4 stages. Stage 1 payment of 150 million VND is a deposit, serving the patient's and the kidney seller's testing, and the cost of purchasing information from the kidney seller. Stage 2 payment of 150 million VND serves the patient's and the kidney seller's examination, and the council fee, and the kidney seller's accommodation and food costs.

Phase 3 pays 200 million VND for surgery costs and accommodation expenses of the kidney seller. Phase 4 pays the remaining amount after the kidney transplant.

According to the investigation results, from the end of 2020 to June 2023, Ninh successfully bought and sold kidneys in 4 cases. At the time of his arrest by the Investigation Police Agency of Thua Thien Hue Province, Ninh was conducting 3 other kidney trafficking cases. Because Ninh was arrested, these 3 cases have not yet undergone kidney transplants.

In addition to the above cases, Ninh also confessed to having successfully bought, sold and transplanted kidneys to 5 other cases. Because during the investigation, these people were not present in the area, it was unclear where they went or what they did, so the police could not obtain statements and evidence to clarify, so there was no basis for handling.

Through the above kidney trading transactions, Ninh illegally profited hundreds of millions of dong.

At the trial, the defendant confessed honestly, repented, and asked for the lightest sentence possible so he could return to his family soon. After reviewing the case file and the questioning process at the trial, the People's Court of Thua Thien - Hue sentenced Nguyen Van Ninh to 9 years in prison.
