Apartments in Ho Chi Minh City extend suspension of short-term rentals

An urban area with tens of thousands of residents in Binh Thanh District (HCMC) has adjusted the suspension time for short-term accommodation rental services in this urban area to apply from May 15 instead of March 15, after receiving backlash.

The management board of V. urban area in Binh Thanh district has just sent a notice to residents about adjusting the business suspension time for apartments for short-term accommodation rental services.

Accordingly, the management board of V. urban area said that it had worked with representatives of Ward 22 People's Committee, Ward 22 Police, representatives of building management boards and representatives of neighborhoods related to security control and the situation of short-term rental accommodation in the urban area. At the meeting, the management board recorded the opinions of all parties on compliance with the provisions of the law.

However, before implementation, it is necessary to consider the implementation roadmap, ensuring that it is suitable for the characteristics of the urban area. Accordingly, at the end of the meeting, the parties agreed that the suspension of short-term accommodation rental services in the urban area will be applied from May 5 instead of March 15 as previously announced. Particularly for low-rise apartments (from floors 6 to 20) of building L., it will be applied from March 15.

Talking to Tuoi Tre Online , residents said that on March 14, representatives of the apartment management board had a meeting with residents about stopping short-term rentals in the urban area.

At this meeting, residents proposed to temporarily extend the ban on short-term rental activities in urban areas using the Airbnb model to have time to re-study the legal basis of this activity as well as to give service providers time to prepare, avoiding damage to Airbnb service providers.

Ms. TH (a resident of an urban area in Binh Thanh District) said that Airbnb service providers have invested hundreds, even billions of VND in apartments for short-term rental, ensuring income for cleaners, managers, apartment owners, etc. Therefore, Ms. H. believes that policy changes need to have a roadmap, and should not be "ambushed" causing investors and workers to suffer.

Instead of banning, there should be policy corridors to manage short-term accommodation services to comply with the law, add a form of accommodation for tourists , pay taxes and create a stable source of revenue for the budget.

"Current legal regulations do not clearly define the Airbnb model, so Ho Chi Minh City needs to take advantage of Resolution 98 to pilot the Airbnb model of operating under management and control before deciding whether to ban it or allow it to exist," said Ms. H.

Meanwhile, many residents believe that there should be sanctions so that Airbnb activities do not affect the security, lives of residents and facilities of the apartment building because these are common properties and private living spaces of residents.

Mr. Le Hoang Chau - Chairman of the Ho Chi Minh City Real Estate Association - said that there should be regulations so that short-term apartment rental activities like Airbnb can operate within a framework, be managed and meet the needs of a segment of tourists.

However, according to Mr. Chau, it is also necessary to ensure the interests of residents and the inconveniences from Airbnb activities.
