Transferring teachers to other schools but "forgetting" to discuss and exchange information

(NLDO) – Transferring a teacher to another school but the authorities did not discuss or exchange information, causing the teacher to be upset and complain for many years.

The People's Committee of Dak Lak province has just issued a document requesting relevant agencies to urgently handle the petition and complaint about the transfer of civil servants against Ms. Nguyen Thi Kim Nuong (42 years old, teacher at Ea Phe Secondary School).

Ms. Nguyen Thi Kim Nuong was transferred from Ea Kly Secondary School to work at another school, but the authorities "forgot" to discuss and exchange information.

Previously, the Dak Lak Provincial People's Committee had repeatedly directed the case to be resolved to avoid prolonged complaints. However, due to the lack of resolution, Ms. Nuong continued to file complaints to the Provincial People's Committee, the Provincial National Assembly Delegation and sent a petition to the Ministry of Education and Training .

According to Ms. Nuong's reflection, in 2008, she taught biology at Ea Kly Secondary School. In 2022, Ea Kly Secondary School held a meeting to transfer biology teachers to Ea Phe Secondary School and announced that the transferor was a contract teacher.

Unexpectedly, on February 3, 2023, Ms. Nuong was invited by the Principal of Ea Kly Secondary School to present the district's transfer decision to her to teach at Ea Phe Secondary School.

When Ms. Nuong asked why the school had made the transfer decision without meeting or discussing, she was told that it was the decision of the Chairman of the District People's Committee.

On February 10, 2023, Ms. Nuong had a meeting with the Department of Internal Affairs of Krong Pak district (old) and this unit said that transferring her from a surplus school to a shortage school was in accordance with regulations and was objective and fair.

Although she agreed to transfer to a new school, Ms. Nuong filed a complaint to many levels and sectors.

In September 2023, the Department of Home Affairs of Dak Lak province had the results of processing Ms. Nuong's petition. This department pointed out that the People's Committee of Krong Pak district (old) used the term "mobilize civil servants" and did not specify a time limit, which was not in accordance with regulations. In addition, before implementing, the units did not meet Ms. Nuong to listen to her suggestions and opinions before the competent authority made a decision, which was not in accordance with regulations.

In addition, Ea Kly Secondary School and the Department of Internal Affairs of Krong Pak district did not transfer another female teacher because she was a contract teacher and another male teacher because the school union was structuring human resources, but transferring Ms. Nuong was unfounded.

The Department of Home Affairs requested the Chairman of the People's Committee of Krong Pak district to handle Ms. Nuong's petition in accordance with regulations; issue a decision to adjust the content or replace the signed decision; request the Department of Home Affairs to learn from experience in consulting.

However, in October 2024, the People's Committee of Krong Pak district responded in writing to Ms. Nuong that the transfer, arrangement, and assignment of work from a school with a surplus of teachers to a school with a shortage was within the authority and in accordance with regulations!.

Believing that the district's response was contrary to the conclusion of the Department of Internal Affairs, Ms. Nuong continued to complain. To date, Ms. Nuong's complaint has not been satisfactorily resolved.
