From July 1, 2024, the Law on Cooperatives (Law) 2023 officially took effect, creating a favorable and open legal corridor for the development of collective economic organizations (CEOs). The Law on Cooperatives 2023 has continued to improve regulations on the organization and operation of cooperatives, meeting the development requirements of the CEO sector in the new period.

In the province, the collective economic zone occupies an important position with over 1,100 cooperatives and more than 600 cooperatives in operation; attracting over 113,000 members, creating regular jobs for about 13,500 workers with an average income of 5 million VND/person/month.

According to Ms. Vu Thi Minh Tam - Permanent Vice President of the Provincial Cooperative Union, the operation methods of cooperatives in recent years have changed significantly, forming a number of bright spots of agricultural cooperatives producing according to the value chain associated with local key products. The whole province has over 150 cooperatives with commodity products, nearly 130 cooperative products meeting OCOP standards of 3 stars or higher. The Law on Cooperatives 2023 and sub-law documents coming into effect are favorable conditions, creating a basis for cooperatives to consolidate their organizations, improve their capacity, promote advantages with new directions, and increase competitiveness in the market.

Compared to the 2012 Law on Cooperatives, the 2023 Law on Cooperatives has many new points, clarifying the nature and role of cooperatives in supporting and developing members, ensuring and promoting the characteristics and basic principles of cooperatives, attracting many components and participants. Cooperatives have a number of additional rights such as: Establishing enterprises to support the activities of collective economic organizations; requiring members to register their needs for using products and services to develop and implement plans for supplying and consuming products and services for members; providing products and services to the outside after fulfilling obligations and ensuring the interests of members... At the same time, it has fully institutionalized 8 groups of policies of Resolution No. 20-NQ/TW, dated June 16, 2022 at the 5th Conference of the 13th Party Central Committee on continuing to innovate, develop, improve the efficiency of collective economic organizations, creating motivation to promote sustainable development of collective economic organizations and cooperatives.

Ms. Duong Thi Duyen - Director of Thanh Nam Tea Cooperative, Thanh Son town, Thanh Son district said: “Our cooperative operates in the field of tea production and processing, with a processing capacity of about 1 ton of fresh tea buds/day. Through the propaganda forms of the Provincial Cooperative Union and the functional units of the district, I have been able to access and learn about the new points of the 2023 Law on Cooperatives. In particular, what I am particularly interested in is the regulation on adding types of members participating in cooperatives, including official members, capital-contributing associate members and non-capital-contributing associate members, along with the regulation on the maximum capital contribution ratio for an official member not exceeding 30% of the total charter capital of the cooperative, creating favorable conditions for cooperatives in increasing capital sources”.

In order for the Law on Cooperatives 2023 to come into practice, the provincial functional branches and local authorities continue to innovate and improve the quality of content, forms, and methods of propaganda and guidance on the implementation of the Law, ensuring suitability, practicality, and effectiveness for each subject. In particular, focus on guiding, advising, and supporting cooperative groups, cooperatives, and members to quickly access the Law on Cooperatives 2023, effectively implementing support mechanisms and policies. Regularly monitor and grasp the advantages, difficulties, and obstacles of cooperatives when applying the provisions of the Law on Cooperatives 2023, thereby having appropriate support solutions.
