Business owner fined over 100 million for re-offending selling counterfeit goods in Da Nang

Da Nang: A store repeats selling counterfeit goods, fined over 100 million VND

The People's Committee of Da Nang City has just issued a decision to administratively fine a BL business household on Tran Phu Street, Hai Chau District, a total of more than VND111 million for displaying and selling counterfeit goods and reoffending.

Previously, on May 20, the market management force conducted a surprise inspection of this store and discovered 127 handbags with signs of counterfeiting high-end brands protected in Vietnam, including Chanel, Louis Vuitton, Gucci, Prada, Christian Dior and Celine. The total value of this infringing shipment was determined to be nearly VND152 million.

Notably, this is not the first time this facility has violated the law. According to records, Market Management Team No. 1 has previously fined BL business households for similar acts. Therefore, this violation is determined to be a repeat offense, an aggravating circumstance.

Due to repeated violations, the People's Committee of Da Nang City has imposed a strict penalty. In addition to having to pay a fine of more than 111 million VND, the owner of the facility was also forced to destroy all 127 counterfeit branded handbags according to the law.

Binh Dinh discovers many violations of counterfeit, smuggled and poor quality goods

In Binh Dinh province, market management teams have coordinated with police, customs and local authorities to conduct many surprise inspections to promptly detect and handle acts of smuggling and trading of goods of unknown origin.

On June 9 and 10, Market Management Team No. 3 coordinated with the police and customs forces to inspect two tractor-trailers passing through the area and discovered that the trucks were carrying more than 77 tons of black liquid with an oil smell, suspected to be FO oil. The entire shipment had no invoices or documents proving its legal origin. According to the initial declaration, the goods were transported from Ba Ria - Vung Tau province to be consumed in Binh Dinh and Quang Nam .

Previously, on June 3 and 4, Market Management Team No. 4 conducted a surprise inspection of two business households in Dap Da Ward and Binh Dinh Ward (An Nhon Town), discovering 2,130 children's toy products, including knives, swords, and plastic guns of unknown origin. In addition, the authorities also temporarily seized more than 190 cosmetic products without product declaration forms, invoices, and documents, violating regulations on labeling and quality declaration.

According to Mr. Nguyen Dinh Kha, Deputy Director of the Department of Industry and Trade, the Department continues to strictly implement the direction of the Central and the province in the fight against smuggling and trade fraud. In addition, local authorities from the grassroots to the province have established working groups to fight, prevent and repel smuggling, trade fraud, counterfeit goods, poor quality goods, and goods that do not ensure food hygiene and safety from entering the market to protect the rights and health of consumers.

In addition, the Market Management Force shall develop specific plans and strategies and synchronously and regularly carry out market inspection and control activities to promptly prevent and handle violations. Organize businesses, facility owners, and small traders to sign commitments not to trade in counterfeit, smuggled, or poor-quality goods; strictly handle cases that have signed commitments but do not comply.

Carrying out the peak period of the fight against smuggling, trade fraud and counterfeit goods from May 15 to June 15, the People's Committee of Khanh Hoa province directed all levels, sectors and functional forces in the area to take drastic action and synchronously deploy many solutions to inspect and control the market.

During this time, the Market Management Force conducted 74 inspections, detected 32 violations, and imposed administrative fines of over VND200 million. The police force discovered 2 cases, temporarily confiscating nearly 6,000 cosmetic products without invoices, more than 34,000 anti-counterfeit stamps, boxes, and labels of fake cosmetic brands.

Border guards and customs also handled cases of transporting minerals and DO oil without valid documents. Tax authorities inspected 154 businesses, collecting and imposing fines of more than VND15.6 billion. The Department of Health inspected 129 medical, pharmaceutical, cosmetic and food establishments and discovered 3 establishments violating regulations.

Standing Vice Chairman of Khanh Hoa Provincial People's Committee Le Huu Hoang requested that functional forces proactively develop a thematic inspection plan, strictly handle violations, promote propaganda and dissemination of laws, and organize the signing of commitments not to trade in counterfeit, poor quality, or unknown origin goods to raise awareness and protect consumer rights.
