The 2024 Land Law was passed by the 15th National Assembly at the 5th Extraordinary Session on January 18, 2024. In order to implement the plan to implement the Land Law No. 31/2024/QH15 (issued together with Decision No. 222/QD-TTg dated March 5, 2024 of the Prime Minister), the Ministry of Natural Resources and Environment has presided over and coordinated with relevant ministries, central agencies and localities to draft a Government Decree regulating land prices.
As of May 23, the Ministry of Natural Resources and Environment received 17/26 comments from Government members and comments from localities, organizations and experts. The Ministry has also received and completed the draft Decree consisting of 6 chapters and 41 articles. Accordingly, the draft Decree clearly stipulates the contents of land valuation methods; procedures and contents of land price determination according to the land price adjustment coefficient method; factors affecting land prices; land price list, etc.

At the conference, delegates gave their opinions on the following contents: Costs of determining land prices using the surplus method, methods for calculating interest costs, investor profits, and contingency costs.
Regarding the surplus method, there are opinions suggesting that the area to calculate revenue and expenses in the surplus method is the total area of the project according to the detailed construction plan or the master plan up to the time of land valuation, allocated according to the area ratio for the handed over area...
Concluding the conference, Deputy Prime Minister Tran Hong Ha highly appreciated the synthesis work of the drafting agency, the Ministry of Natural Resources and Environment, which has received and explained opinions to develop a draft Decree regulating land prices that is scientific and effective. He requested the drafting agency to receive maximum comments, revise the wording to ensure logic and ease of understanding, and promptly complete the draft for submission to the Government, ensuring that the Decree, once issued, will address practical requirements. The Ministry of Finance needs to recalculate and reconsider all types of costs, ensuring compliance with legal regulations, and harmonizing the interests of the State, people and businesses.
