University in Ho Chi Minh City uses 9 foreign workers without permission

The Inspectorate of the Department of Labor, War Invalids and Social Affairs (LĐ-TB&XH) of Ho Chi Minh City has just announced the conclusion of the inspection on the use of foreign labor at Van Lang University.

Accordingly, at the time of inspection, the total number of foreign employees working at Van Lang University under labor contracts and research contracts was 16 people (based on the June salary table). Of these, 8 people did not have work permits.

In addition, the school signed a labor contract with a foreigner without a work permit. At the time of the inspection, this person had quit his job on May 1 and left Vietnam on June 5.

During the inspection process, the Chief Inspector of the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City concluded that Van Lang University had complied with many legal regulations on the use of foreign workers in Vietnam. The unit had 7 foreign workers with work permits; signed labor contracts; the term of the labor contract did not exceed the term of the work permit; implemented the salary scale and payroll according to regulations...

However, Van Lang University also violated the law by employing 9 foreign workers at the facility without a work permit. At the time of the inspection, the Inspectorate of the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City requested the school to immediately stop the violation and draw up a record of administrative violations for the above behavior.

The Inspectorate of the Department of Labor, Invalids and Social Affairs determined that the above behavior violated the provisions of Point a, Clause 4, Article 32 of Decree No. 12/2022/ND-CP dated January 17, 2022 of the Government stipulating administrative sanctions for violations in the fields of labor, social insurance, and Vietnamese workers working abroad under contracts.

Accordingly, employers who employ foreign workers in Vietnam without a work permit will be fined from 30 million VND to 45 million VND (applied to violations of 1 to 10 people).

In the inspection conclusion, the Chief Inspector of the Department of Labor, Invalids and Social Affairs of Ho Chi Minh City acknowledged the contents of the use of foreign labor that Van Lang University had done well and requested the school to stop using foreign labor working in Vietnam without a license.
