Ministry of Health requests review of classification and announcement of cosmetic features and uses

On August 5, the Drug Administration of Vietnam (Ministry of Health) issued a document requesting health departments of provinces and cities to review, classify, and publish the features and uses of cosmetics.

The document clearly states that although there are regulations on the classification of cosmetics and the declaration of cosmetic product features implemented according to the ASEAN Guidelines on the declaration of cosmetic product features, through the inspection and post-sale supervision of cosmetics circulating on the market in recent times, some domestically produced cosmetic products are still not classified as cosmetics or contain some ingredients that do not conform to the definition of cosmetics that are granted a Product Declaration receipt number.

Specifically, some products contain permethrin, while permethrin, CAS number: 52645-53-1, is an insecticide, belonging to the pyrethroid family, listed as an essential drug by the World Health Organization, classified as an insecticide (ATC code: P03AC04). In addition to its insecticidal effect, permethrin also has the effect of treating parasites in humans, and treating ticks and fleas in pets. Some products have misleading uses and instructions for use as medicines; some sunscreen products, labeled with SPF (Sun Protection Factor), have sunscreen effects that are not in accordance with the guidelines of the ASEAN Cosmetics Agreement.

To ensure safety for users and comply with regulations on cosmetic management, the Drug Administration of Vietnam requests that the health departments of provinces and cities review the Cosmetic Product Declaration Forms that have been granted reception numbers to ensure compliance with regulations on cosmetic classification and declaration of cosmetic product features according to the instructions in Appendix 03-MP Circular No. 06/2011/TT-BYT.

Revoke the issued Cosmetic Product Declaration Receipt Number for products that are not classified as cosmetics or that misrepresent the inherent nature of the cosmetic product or declare features and uses that are misleading as drugs. Fully update the ASEAN Cosmetic Council's guidelines and regulations, the list of substances not allowed to be used in cosmetic products, the list of substances with prescribed concentration and content limits in cosmetic products, the list of colorants allowed to be used in cosmetic products, the list of preservatives allowed to be used in cosmetic products, the list of UV filters in cosmetic products; disseminate to production and business establishments in the area, ensuring that only cosmetic products are circulated, distributed and used.

At the same time, strictly handle and punish organizations and individuals who violate the regulations on the announcement, production and trading of cosmetics according to current regulations; recall and destroy all types of cosmetics that do not ensure safety for users.
