New steps in cyberspace management

The Government has just issued Decree No. 147/2024/ND-CP on the management, provision and use of internet services and online information. From the perspective of social networking platforms, how can the provisions in this Decree be effective and efficient?


Enhance information security

On November 9, 2024, the Government issued Decree No. 147/2024/ND-CP on management, provision and use of internet services and online information.

In particular, the decree stipulates many new points such as: phone number must be verified to be able to post, comment, livestream on social networks, etc.

Authenticating social media accounts with phone numbers or personal identification numbers helps social media platforms protect users from fake accounts, scams, or unauthorized account intrusions.

This regulation also helps each individual social network user raise their sense of responsibility when speaking, sharing, commenting, and behaving in cyberspace.

In addition, when deployed, it will eliminate fake accounts - which are one of the causes of information noise on social networks.

For this regulation to effectively achieve its intended goals, social media platforms need to have strong data protection measures in place and not misuse users' personal information.

Not only that, social media platforms also need to give users choices about how to protect their privacy.

Improve the review process

Decree No. 147/2024/ND-CP also clearly stipulates the prevention and removal of illegal content. Accordingly, service providers must be responsible for censoring harmful content on their platforms. Within 24 hours of receiving a request from the authorities, providers must remove illegal content.

To comply with this regulation, social network service providers will face a huge workload pressure when having to review and remove violating content in a short time.

Obviously, social media platforms need to invest in human resources and technology (artificial intelligence (AI) and automated moderation tools) to improve and upgrade their monitoring and processing systems.

In addition, during the review and processing process within just 24 hours, errors may arise, such as mistakenly deleting non-violating content.

This can affect users' freedom of speech, when legitimate posts and comments are removed without cause.

To balance between complying with the provisions of Decree 147/2024/ND-CP and protecting users' freedom of speech, social networking platforms, in addition to improving the censorship and handling process within the platform, need to ensure transparency, allow users to appeal (if the handling is wrong), and encourage the participation of the user community.

It is also important to note that social media platforms need to develop clear criteria to distinguish between “violating content” and “controversial content”.

Avoid abuse of power

Requiring temporary or permanent blocking of accounts with repeated violations will bring many benefits in preventing violations, creating motivation and pressure for users to strictly comply with the regulations of social networking platforms.

This is a sanction aimed at deterring users who commit violations, especially actions such as spreading false information, propagating violence, inciting hatred, or committing online fraud.

However, it is also necessary to limit the negative effects arising from this regulation. For example, the situation where social networking platforms accidentally make mistakes in the process of identifying violations.

It is even possible to abuse power, unfairly remove the right to participate in social networks, and harm the freedom of speech of individuals.
