Trump administration spars with judge over deportation case

A US federal judge has asked the Trump administration to explain its decision to ignore a ruling to deport hundreds of Venezuelans the government considers criminals.


US District Court Judge James Boasberg convened the hearing on March 17, after the American Civil Liberties Union (ACLU) filed a complaint, arguing that the administration had violated the court's ruling.

Earlier, Mr. Boasberg issued a ruling on March 15 that prevented the Trump administration from invoking the Foreign Enemies Act of 1798 - a law previously used only in wartime, allowing foreigners to be deported without cause or trial in court.

However, the US government ignored the ruling and continued to enforce the deportation decision, organizing flights to take 261 people out of the US to El Salvador on March 15. The White House emphasized that the deportees belonged to the Venezuelan criminal gang Tren de Aragua.

White House press secretary Karoline Leavitt said the White House would only follow a written ruling from a judge, not an oral one. At a hearing on March 17, US Justice Department official Abhishek Kambli, representing the government, argued that a judge's oral ruling was not as binding as a written one.

“The government can ignore the order because it’s not in writing,” Judge Boasberg asked. “Wouldn’t it be better to just send the planes back to the United States, rather than ignore them and say, ‘We don’t care. We’ll do what we want’?”

Leavitt said the planes had left the country before the judge’s order. Meanwhile, Trump administration border official Tom Homan told Fox News: “We’re not going to stop. I don’t care what the judge thinks, I don’t care what the left thinks.”

The US media said the case could create a constitutional crisis if the government ignores the ruling. Judges' rulings in court are as binding as written judgments that are later provided.
