Fighting counterfeit goods and fake news: Need strong enough sanctions and a wide enough legal corridor

(Chinhphu.vn) - "Preventing counterfeit goods, fake goods and fake information that harm businesses" was the topic of the discussion organized by Ho Chi Minh City Law Newspaper on the morning of July 10. The event took place in the context of the Government's drastic efforts to prevent counterfeit goods with Prime Minister Pham Minh Chinh consecutively issuing Official Dispatches No. 65, 82 and Directive No. 13 in May and June 2025.

The panel acknowledged the increasingly complex challenges in the fight against counterfeit goods and misinformation. In today's market, counterfeit goods are infiltrating many essential sectors such as food, milk, medicine, functional foods and luxury goods, while control efforts are still not strong enough. At the same time, fake information is spreading on cyberspace, causing serious consequences, disrupting consumer awareness, causing losses to businesses and eroding social trust.

"Blue tick of responsibility": The key to screening reputable businesses

At the seminar, Mr. Nguyen Nguyen Phuong, Deputy Director of the Department of Industry and Trade of Ho Chi Minh City, said that handling goods after seizure is more complicated than detecting violations. At the same time, the current legal framework is outdated and has not kept up with sophisticated law-evading behaviors, especially anonymous subjects operating on social networks.

In response, the Department of Industry and Trade has launched the "Responsible Green Tick" program, calling on businesses to participate in order to receive product quality certification. The program's special feature is its strict sanctions: If a product with a "green tick" is found to be in violation, all participating supermarkets will simultaneously stop importing goods from that business. However, due to strict regulations, the number of registration applications after more than a year of implementation has only reached a few hundred.

However, Mr. Phuong affirmed that building such a standard framework is a long-term step to improve product quality and protect consumers from the root.

Increase penalties to be sufficiently deterrent

From a management perspective, Mr. Nguyen Thanh Nam, Deputy Director of the Department of Domestic Market Management and Development ( Ministry of Industry and Trade ), said that cyberspace is becoming a favorable environment for counterfeit goods trading and intellectual property rights violations. In the first 6 months of 2025, the Market Management force handled 9,919 violations, with a total administrative fine of up to 266 billion VND and transferred 76 cases with signs of criminality to the investigation agency.

However, Mr. Nam also frankly admitted that many challenges still exist: Current sanctions are too light compared to the profits from counterfeit goods; the law has not kept up with technology and the determination of responsibility of intermediary platforms is still unclear. In addition, the process of counterfeit goods appraisal also takes a lot of time and costs, hindering quick handling.

Based on the above practices, the Department of Domestic Market Management and Development proposed many important solutions. First of all, it is necessary to soon complete the legal framework in the direction of increasing penalties to have sufficient deterrence. At the same time, it is necessary to clearly define the legal responsibilities of social networking platforms and e-commerce platforms in controlling, preventing and removing violating content. In addition, Mr. Nam proposed establishing a rapid appraisal mechanism, while strengthening international cooperation with cross-border platforms such as Facebook and TikTok to effectively handle violations.
