According to current regulations in Article 65 of the 2008 Road Law, drivers of commercial transport vehicles are not allowed to drive continuously for more than 4 hours and the total driving time is not more than 10 hours/day.

Despite many strict regulations, control of drivers and vehicles in the transport business is still lax, causing many risks of traffic accidents from midnight to dawn.

In the draft Road Law, the Ministry of Transport proposed specific regulations on continuous driving time at night and reducing driving time during the day for drivers operating commercial vehicles.

Accordingly, a driver is not allowed to drive for more than 8 hours a day, and the continuous driving time is not more than 4 hours. In particular, from 10pm the previous day to 6am the following day, the continuous driving time for a driver is not more than 3 hours, with a minimum break of 30 minutes.

For taxi and bus drivers, the minimum rest time between two consecutive drives is 5 minutes. For other vehicles, the minimum rest time is 15 minutes.

The Ministry of Transport said that currently, the country has nearly 90,000 licensed automobile transport businesses with about 900,000 vehicles. Of these, there are 308,776 passenger cars and 566,870 trucks of all kinds. The number of drivers in the transport business is over 1 million people. Through data from journey monitoring devices, although localities have increased handling, there are still many drivers violating driving time continuously for more than 4 hours, speeding...

Therefore, it is necessary to issue the above regulation in accordance with the Labor Code to ensure the health of drivers, including the health of drivers at night.

Statistics from the National Traffic Safety Committee analyzing 11,043 traffic accidents that occurred in 2022 showed that traffic accidents occurred mainly at night, of which 40.33% occurred from 4-10 p.m. and 18.24% occurred from 10 p.m. the previous day to 4 a.m. the next day.
