Delegating the right to recruit and mobilize teachers to the Department of Education

The new circular of the Ministry of Education and Training stipulates that the Department of Education and Training has the right to decide on the establishment of school councils, recognition, appointment, dismissal of school council chairman, addition, replacement of school council members; reappointment, extension of working time, resignation from office, dismissal, change of job position, reward, discipline for principals and vice principals of educational institutions under the province according to the title standards and procedures prescribed by law.

Decisions to permit the establishment, dissolution, and termination of operations of preschools and general education institutions proposed by foreign diplomatic missions and intergovernmental international organizations in accordance with current laws.

The Department of Education and Training has the right to recruit, mobilize, second, and transfer teachers and managers of educational institutions.

The Department of Education and Training is also the unit that approves the association of foreign language proficiency certification examinations. Decides to grant, extend, terminate operations, amend and supplement decisions permitting the establishment of representative offices of foreign educational organizations and institutions in Vietnam. Decides to grant, amend, supplement, extend, re-grant, terminate operations and revoke licenses to establish representative offices of foreign vocational education organizations and institutions in Vietnam according to regulations.

Submit to competent authorities to decide or decide on the establishment, permission to establish, reorganize, merge, divide, separate, dissolve, and convert types of educational institutions and decide to establish, permit the establishment of branches, and terminate the operation of branches of secondary schools under their management authority according to current laws.

Regarding the team of teachers and educational institution managers, the Department of Education and Training is assigned to take the lead in implementing the regulations and decentralization of the Provincial People's Committee regarding the recruitment, reception, mobilization, secondment, and transfer of the team of teachers, educational institution managers, civil servants, and employees in public educational institutions in the province.

The Department of Education and Training is also the unit that manages, uses, changes professional titles, trains, fosters, and evaluates teachers, educational institution managers, civil servants, and employees in public educational institutions in the province according to the decentralization of the Provincial People's Committee and the provisions of the Law on Teachers.

The Law on Teachers was passed by the National Assembly last June. One of the outstanding contents of this law is to increase autonomy for educational institutions and give the education sector the authority to recruit teachers, instead of the Department of Home Affairs and the People's Committees at the district level as before.

According to the Ministry of Education and Training, by the end of the 2024-2025 school year, the country will have nearly 1.28 million teachers from kindergarten to grade 12, an increase of 21,978 people compared to the previous year. The Ministry of Education and Training, in coordination with the Ministry of Home Affairs, has proposed adding 10,304 more positions to address the shortage of teachers, especially in disadvantaged areas.
