According to the Department of Trade Defense ( Ministry of Industry and Trade ), the United States does not impose anti-dumping tax on extruded aluminum imported from Vietnam.

The Department of Trade Remedies, Ministry of Industry and Trade said that on October 30, 2024, the US International Trade Commission (ITC) issued a final conclusion on injury in the anti-dumping/countervailing investigation of aluminum extrusions imported from China, Colombia, Ecuador, India, Indonesia, Italy, Malaysia, Mexico, South Korea, Taiwan (China), Thailand, Türkiye, UAE and Vietnam.

US industry has not suffered significant damage

Accordingly, the US International Trade Commission determined that the US industry was not significantly injured by extruded aluminum imported from 14 countries/territories under investigation, although the US Department of Commerce (DOC) had previously concluded that extruded aluminum imported from these countries/territories was dumped/subsidized.

Based on the conclusion of the USITC, the US Department of Commerce will not issue an anti-dumping/anti-subsidy order on aluminum extrusions imported from the above 14 countries/territories.

Previously, on October 24, 2023, the US Department of Commerce (DOC) officially initiated an anti-dumping investigation on aluminum extrusions and aluminum products imported from 15 countries/territories including Vietnam and an anti-subsidy investigation on the same products from 4 countries: Indonesia, Mexico, China, Türkiye. Vietnam was proposed for an anti-dumping investigation.

Product under investigation: Aluminum extrusions and aluminum products (quite broad scope). Case number: A-552-837. Plaintiff: Aluminum, Steel, Paper and Forestry, Rubber, Industrial, Energy, United Service and Industrial Labor Union.

According to the plaintiff, based on US Customs data, in 2022, Vietnam accounted for about 7.6% of the total export turnover of countries to the United States, ranking 4th among the countries exporting the most to the United States, after Mexico, Colombia, China (accounting for 12.9%, 10.2% and 9.1% of the total export turnover of countries to the United States in 2022, respectively).

Exporting enterprises accused of dumping: The Plaintiff named about 14 Vietnamese companies. In addition to these 14 companies, there are other companies that also export the investigated products to the United States. The alleged dumping margin for Vietnam: 41.84% (the alleged dumping margin for 15 countries/territories ranges from 25.89% - 376.85%) and is lower than the alleged level for the 3 most competitive exporting countries of Vietnam to the US market.

Under US investigation regulations, there are two agencies involved in an antidumping/countervailing duty investigation: the US Department of Commerce investigates dumping/subsidy and is responsible for the overall outcome of the investigation, while the US International Trade Commission is responsible for assessing the injury to the domestic industry. Antidumping/countervailing duties are imposed only if both agencies issue an affirmative determination.
