Long term business must start with law

DNVN - “Long-term business – Starting from the law” is the theme of the training program to raise awareness of the law in the digital environment for sellers and digital content creators taking place on the afternoon of June 25 in Hanoi.

The training program “Long-term business – Starting from the law” was organized by the Center for E-commerce and Digital Technology Development (eComDX), the Department of E-commerce and Digital Economy ( Ministry of Industry and Trade ) in coordination with consulting units. The event attracted more than 700 sellers, content creators and e-commerce experts.

Mr. Nguyen Huu Tuan - Director of eComDX emphasized that the legal corridor for e-commerce in Vietnam is increasingly complete with key documents such as Decree 52/2013, Decree 85/2021, Law on Electronic Transactions 2023, Law on Protection of Consumer Rights... These regulations comprehensively regulate everything from website registration to contracts, payments and dispute resolution.

Mr. Tuan noted that both sellers and e-commerce platforms must strictly comply with legal regulations. In particular, sellers must be transparent about information, sales policies and register their operations with the Ministry of Industry and Trade; e-commerce platforms must build a control mechanism, support dispute resolution, coordinate the management of counterfeit and banned goods, and protect users' personal data.

Regarding the draft Law on E-commerce, Mr. Tuan said that the new law is being developed to keep up with modern digital business models, but also needs to avoid overlapping with current laws. Major issues being consulted include: legal responsibilities of e-commerce platforms, cross-border transaction tax management, simplification of administrative procedures and protection of personal data.

“Legality is the backbone of the digital economy . E-commerce cannot develop strongly and sustainably without a transparent and practical legal framework,” the Director of eComDX emphasized.

Mr. Nguyen Viet Hoa - Head of Tax Management Department No. 2 (Tax Management Department of E-commerce Platforms) under the E-commerce Tax Department - Ministry of Finance affirmed that the tax sector prioritizes the completion of the tax legal framework for e-commerce, continuously reviewing and supplementing to ensure consistency and efficiency in the face of the rapid development of e-commerce platforms and cross-border business activities. The goal is to create a level playing field, prevent tax losses without hindering the development of e-commerce.

Regarding tax declaration and payment via digital platforms, Mr. Hoa assessed that this is a big step forward, bringing double benefits when helping businesses, individuals and business households save time and costs through the General Department of Taxation's Electronic Information Portal (eTax) or the eTax Mobile application. In particular, the information portal for households and individuals doing business on e-commerce platforms has made declaration more transparent and easier.

Mr. Hoa recommends that taxpayers should regularly update the declaration support software, carefully check the information, and should not wait until the deadline to make transactions when the transmission line is easily overloaded due to receiving too many declarations at the same time. The tax sector is always ready to support and accompany the digital business community to make the tax obligation implementation process go as smoothly as possible.

Ms. Nguyen Thi Cam Giang - representative of TikTok Shop's Legal Department said that to do business legally in Vietnam, sellers need to fully comply with legal regulations related to e-commerce, taxes, consumer protection, intellectual property and information security. In addition, depending on the industry, some specialized requirements must also be met.
