Article 14 of the Law on Road Traffic Order and Safety clearly stipulates that vehicles requesting to overtake are only allowed when safety conditions are ensured. On roads with one lane of motor vehicles in each direction, the following vehicle must move to the left to overtake.
However, in special cases when the vehicle in front has a left turn signal or is turning left, if it encounters a special-purpose vehicle working on the road and cannot pass on the left, the driver is allowed to pass on the right.
It is noteworthy that overtaking must comply with lane rules, as stipulated in Article 13 of the Law. This is to ensure that overtaking does not cause obstruction or create dangerous situations for other vehicles.
From January 1, 2025, the Law on Road Traffic Safety and Order officially comes into effect, which regulates overtaking and giving way to overtaking vehicles.
One of the most important requirements that drivers need to remember is the responsibility to yield when another vehicle is overtaking. The driver of the vehicle in front must observe the road ahead, and if it is safe, they must reduce speed, signal right and move close to the right to yield the right of way.
In case of an obstacle or unsafe conditions, the driver in front must signal a left turn to inform the following vehicle that it is not possible to overtake in that situation. This is an important regulation to avoid dangerous situations that can occur when trying to overtake at the wrong time.
Vehicles wishing to overtake must signal by flashing their headlights or using their horns, except for rudimentary vehicles which do not have lights or horns. During overtaking, vehicles must signal to change direction, ensuring a safe distance from the vehicles in front and behind.
In particular, in urban areas and densely populated areas, from 10pm to 5am, overtaking signals are only made by lights, to minimize noise and avoid disturbing residents.
The new law also clearly stipulates cases where overtaking is prohibited, including when safety conditions are not guaranteed, on narrow bridges with one lane, on curves or at the top of slopes with limited visibility, at intersections or at road crossings at the same level as railways.
In addition, drivers are not allowed to overtake when weather or road conditions are unsafe, when encountering priority vehicles, on pedestrian crossings, in wheelchairs of the disabled, and in road tunnels.
