Reuters reported that federal judge Tanya Chutkan in Washington DC on December 1 ruled that Mr. Trump did not enjoy immunity from criminal prosecution related to his actions while president. "Although a sitting president may enjoy immunity, the United States has only one leader at a time, and that position does not provide a lifetime 'get out of jail free card,'" Ms. Chutkan wrote in the ruling.

On the same day, judges at the Washington DC Circuit Court of Appeals concluded that Mr. Trump could be sued in civil proceedings for his role in the Capitol riot on January 6, 2021. According to the ruling, Mr. Trump acted "in his personal capacity as a presidential candidate" when calling on supporters to march to the Capitol that day, while the US president is only immune from civil lawsuits for actions in his official capacity.
