
Many complex cases are resolved
From mid-2023, the Chairman of the Provincial People's Committee will direct departments, branches, and localities to review and "name" outstanding cases and report to the Provincial Inspectorate for synthesis.
On that basis, the Provincial Inspectorate is assigned to preside over and coordinate with relevant agencies, units and localities to research, advise and propose to the Provincial People's Committee to focus on resolving or direct departments, branches and localities to resolve according to their authority.
The provincial inspectorate said that out of 213 long-standing cases that the sector has compiled, 20 cases have been resolved so far. Among these, in the field of administrative procedures on land, there is a case related to the issuance of land use right certificates in cases of land use debt of resettled households in Nui Thanh district.
Regarding the problem that led to the prolonged existence of this case, according to the professional sector, in the past, Nui Thanh has arranged resettlement land to clear the ground to carry out many works and projects serving socio -economic development.
However, up to now, many households and individuals who are subject to resettlement have not been granted land use right certificates. The main reason is that there are not enough legal documents on resettlement land allocation, and financial obligations to the State have not been fully fulfilled (not paid land use fees)...
In Report No. 65 dated April 9, 2024, the Provincial Inspectorate said that for the remaining 193 cases, the industry will continue to monitor, coordinate, advise, and recommend solutions to resolve them.
According to the analysis of the Provincial Inspectorate, the remaining cases are mainly concentrated in the field of natural resources and environment, with 154 cases. Specifically, there are 28 cases related to land acquisition, compensation, support, and resettlement; and 6 cases related to resettlement and migration in landslide areas.
There were 40 cases related to commercial housing projects. There were 49 cases related to land finance; 15 cases related to land administrative procedures and 5 cases related to environment. There were 11 cases related to land disputes and state management of land.
In the field of Labor, Invalids and Social Affairs, there was a case related to difficulties in implementing the policy of exemption and reduction of land use fees for meritorious people and their relatives in Tam Ky City. Regarding the specific settlement results, on October 26, 2023, the Provincial People's Committee issued Official Dispatch 7283 assigning the Provincial Tax Department to preside over drafting legal documents on the above content.
Based on Submission 435 dated January 15, 2024 of the Director of the Provincial Tax Department, on January 16, 2024, the Provincial People's Committee issued Decision No. 02 stipulating the procedure for circulating dossiers to issue decisions allowing exemption or reduction of land use fees for people with meritorious services in the province.
Meanwhile, in the field of investigation and prosecution, there was a case of denouncing the act of destroying the Phan clan church in Sam Linh Tay village (Tam Quang commune, Nui Thanh) according to a citizen's petition on October 14, 2022.
During the investigation, due to many difficulties, the Investigation Police Agency of Nui Thanh District Police consulted with the Provincial Police and held an interdisciplinary judicial meeting: Investigation Police Agency - People's Procuracy - People's Court of Nui Thanh District and the province to discuss, evaluate documents and evidence, and agree on a direction to resolve the case.
Pursuant to Articles 36, 37, Clause 7, Article 175 of the Penal Code, on January 18, 2024, the Investigation Police Agency of Nui Thanh District Police issued a decision not to prosecute the criminal case against the source of information about the above crime.

Continue to urge resolution
Mr. Tran Huu Quang - Head of the Professional Department (Provincial Inspectorate) said that the cases that were "named" so that departments, branches and localities could focus on resolving them according to the direction of the Provincial People's Committee were all difficult and complicated cases, so resolving them took a long time; leading to prolonged backlogs, affecting the rights of people and businesses.
To completely resolve the remaining cases, in addition to removing legal obstacles, it requires perseverance and active coordination of relevant sectors and localities. Because, according to analysis, the cases that have not been completely resolved until now are mainly related to the field of land and commercial housing residential projects.
With the results of the settlement in the past time, the Provincial People's Committee directed the departments, branches, sectors, district-level People's Committees and related units according to their functions and tasks to continue to focus on reviewing, resolving or coordinating to resolve according to their authority the cases that are still stuck and have been pending for a long time according to the direction of the Provincial People's Committee and according to the summary results and recommendations of the Provincial Inspectorate.
According to Mr. Tran Huu Quang - Head of Professional Department 1 (Provincial Inspectorate), for problems that are complicated or exist due to unclear legal regulations or are under the jurisdiction of higher levels, the Provincial People's Committee requests to synthesize, report, and propose in each field to the departments and branches performing the function of advising on state management of the industry and field for guidance on resolution or synthesize and propose to competent authorities for consideration and resolution.
"The Provincial People's Committee assigns the Departments of Natural Resources and Environment, Planning and Investment, Industry and Trade, Construction, Agriculture and Rural Development, Transport, Labor, Invalids and Social Affairs, and Home Affairs to be responsible for monitoring and urging departments, sectors, and localities to implement, guide, and resolve according to their authority or propose to competent authorities to consider and resolve cases under their respective sectors and fields," said Mr. Quang.
