The current Law on Social Insurance (SI) 2014 stipulates that voluntary SI only enjoys two regimes: retirement and death benefits. However, at Point a, Article 3, the Social Insurance Law 2024 has added maternity benefits for voluntary SI participants.
According to the provisions of Articles 94 and 95 of the Social Insurance Law 2024, employees participating in voluntary social insurance, including female employees giving birth and male employees whose wives give birth, if meeting the conditions (paying social insurance for 6 months or more within 12 months before giving birth), will receive a subsidy of 2 million VND for each child born and each fetus from 22 weeks old or older that dies in the uterus or dies during labor.
Thus, when the Social Insurance Law 2024 comes into effect, there will be 4 social insurance regimes that voluntary social insurance participants will enjoy, including: maternity allowance, retirement, death, and occupational accident insurance. These are new points in the Social Insurance Law 2024, helping to improve the rights of participants to encourage people to participate in voluntary social insurance.
