From July 1, who is exempted from mandatory social insurance?

More people are exempted from paying compulsory social insurance, while first-time individual business owners must pay a minimum of nearly 600,000 VND/month.

According to the new Social Insurance Law, some groups of people are not subject to compulsory social insurance.

From July 1, the Social Insurance Law 2024 takes effect, which stipulates the following cases not included in the group of compulsory social insurance participants:

- People receiving pension, social insurance benefits, monthly benefits.

- Labor is a domestic worker.

- Registered business owners or enterprise managers, controllers, representatives of state capital/enterprises, general directors, directors, members of the board of directors, supervisory board, controllers and other elected management positions of cooperatives and cooperative unions as prescribed by the Law on Cooperatives, if they do not receive salaries and have reached retirement age under the Labor Code.

The 2024 Social Insurance Law also stipulates that people who have stopped paying compulsory social insurance but are still short of 6 months of social insurance to be eligible for pension can continue to pay voluntary social insurance. In 2025, the retirement age for men is 61 years and 3 months. For women, the retirement age is 56 years and 8 months.

The contribution level is equal to the total previous contribution level (including the employee's and employer's part) to the pension and death benefit fund. However, this additional contribution period is not counted as the time spent working in arduous, toxic, dangerous jobs or in areas with special socio -economic difficulties.

The 2024 Social Insurance Law expands the subjects participating in compulsory social insurance, in which for the first time individual business owners are included in the compulsory participation in the social insurance system.

According to regulations, business owners must pay a total of 25% of their salary as the basis for social insurance contributions, including 3% to the sickness and maternity fund and 22% to the retirement and death fund. Regarding the method, you can choose to pay monthly, every 3 months or every 6 months, depending on your needs.

The household head can choose the salary level as the basis for payment, not lower than the reference level and not exceeding 20 times the reference level at the time of payment.

Currently, the basic salary is 2,340,000 VND/month, so the minimum contribution is 585,000 VND/month (25% × 2,340,000 VND). Meanwhile, the maximum contribution can be up to about 11.7 million VND/month if choosing the maximum reference salary.
