From March 20, 2025, no party members will be disciplined for having a third child.

On March 20, 2025, the Central Inspection Commission issued Instruction No. 15-HD/UBKTTW amending and supplementing a number of contents in Instruction No. 05-HD/UBKTTW dated November 22, 2022 on implementing Regulation No. 69-QD/TW of the Politburo on disciplining party organizations and party members who violate the law.

Accordingly, party members who have a third child will not be subject to disciplinary action.

This instruction is effective from the date of signing.

This is a step to concretize the direction of the Politburo in Official Dispatch No. 13421-CV/VPTW dated February 17, 2025, after reviewing 7 years of implementing Resolution No. 21-NQ/TW dated October 25, 2017 on population work in the new situation. The Politburo has agreed on the policy of amending Party regulations and laws related to population policy, including not disciplining Party members who have a third child or more, and affirming that there will be no retroactive action against previously handled cases.

According to Instruction 15-HD/UBKTTW, points 8.1 and 8.2, section III in Instruction No. 05-HD/UBKTTW in 2022 on instructions for implementing a number of articles in the Regulations on disciplinary action against party organizations and party members who violate the law have been removed. These are the points regulating the consideration and disciplinary action against violations of population policy, including having a third child.

At the same time, the new guidance adds point 8.3 as follows: "Do not consider handling the behavior specified in Clause 2, Article 1 of Ordinance No. 08/2008/PL-UBTVQH12 dated December 27, 2008 amending Article 10 of the 2003 Population Ordinance "Giving birth to one or two children, except in special cases prescribed by the Government".

With this change, from March 20, 2025, having a third child is no longer a violation subject to Party discipline.

The removal of the disciplinary regulation for party members having a third child aims to flexibly adapt to changes in population structure and the requirements for sustainable development in the new situation. The preliminary report on the implementation of Resolution 21-NQ/TW determined that our country's population structure is rapidly shifting to the aging stage, with low birth rates persisting in many areas, especially in provinces and cities with developed socio-economic conditions.
