Which vehicles must be equipped with fire extinguishers?
Clause 1, Article 1 of Circular 148/2020/TT-BCA amends and supplements a number of articles of Circular 57/2015/TT-BCA as follows:
- Replace the phrase "cars with 4 seats or more" in Clause 1, Article 1 and Clause 1, Article 4 with the phrase "cars with more than 9 seats".
Pursuant to Appendix I of the list and standards for fire prevention and fighting equipment for road motor vehicles in Circular 148/2020/TT-BCA, it is stipulated as follows:
- Cars with more than 9 seats are not required to be equipped with fire prevention and fighting equipment.
- Cars with 10 to 30 seats must be equipped with 2 portable fire extinguishers with a fire extinguishing agent capacity of not less than 2kg or a portable CO2 fire extinguisher with a fire extinguishing agent capacity of not less than 2kg or a portable water-based fire extinguisher with a fire extinguishing agent capacity of not less than 3 liters.

- Cars with more than 30 seats must be equipped with 2 portable fire extinguishers with a fire extinguishing agent capacity of not less than 2kg or a portable CO2 fire extinguisher with a fire extinguishing agent capacity of not less than 2kg or a portable water-based fire extinguisher with a fire extinguishing agent capacity of not less than 3 liters.
For this type of vehicle, there must be an additional portable dry powder fire extinguisher with a fire extinguishing agent capacity of not less than 4kg or a portable CO2 fire extinguisher with a fire extinguishing agent capacity of not less than 5kg or a portable water-based fire extinguisher with a fire extinguishing agent capacity of not less than 6 liters.
Cars not equipped with fire extinguishers are subject to administrative penalties
Pursuant to the provisions of Clause 2, Article 16 of Decree 100/2019/ND-CP, amended by Clause 9, Article 2 of Decree 123/2021/ND-CP as follows:
Penalties for drivers of automobiles (including trailers or semi-trailers towed) and vehicles similar to automobiles who violate regulations on vehicle conditions when participating in traffic.
1. A fine of VND 100,000 to VND 200,000 shall be imposed for driving a vehicle without a windshield or with a broken windshield or one that is ineffective (for vehicles designed with a windshield).
2. A fine of VND 300,000 to VND 400,000 shall be imposed for one of the following violations:
a) Driving a vehicle without adequate headlights, license plate lights, brake lights, signal lights, windshield wipers, rearview mirrors, seat belts, escape tools, fire fighting equipment, air pressure gauge, vehicle speedometer, or having such equipment but it is not functional or does not meet design standards (for vehicle types required to have such equipment), except for violations specified in Point m, Clause 3, Article 23, Point q, Clause 4, Article 28 of this Decree.
b) Driving a vehicle without a horn or with a horn that is not working.
c) Driving a vehicle without a muffler or smoke reduction device, or one that is ineffective and does not meet environmental standards for emissions and noise.
Thus, based on the above regulations, drivers of cars not equipped with fire fighting equipment will be fined from 300,000 VND to 400,000 VND.
In addition to being subject to penalties, drivers who commit violations are also subject to remedial measures as prescribed in Clause 9, Article 16, Decree 100/2019/ND-CP, amended by Clause 9, Article 2, Decree 123/2021/ND-CP, which is to be required to fully install equipment or replace equipment that meets technical safety standards or restore the technical features of the equipment as prescribed.
