Ministry of Health responds to voters' petitions before the 9th Session of the 15th National Assembly

Editor's note: Carrying out the task of meeting voters before the 9th Session of the 15th National Assembly, the National Assembly Delegation of Dak Lak province organized a specialized TXCT Conference on the health sector. Based on the synthesis of voters' opinions and recommendations, the National Assembly Delegation of the province forwarded them to competent authorities for consideration and resolution according to regulations; thereby, the Ministry of Health has issued a written response. 1. Voters reflect: Currently, the drug bidding process has many situations that arise, leading to some items not being able to select contractors. Medical staff are professionally trained in the field of medical examination and treatment, have specialized medical knowledge, and focus on treatment, so there are still limitations in updating and systematizing legal documents guiding the bidding field, leading to difficulties in organizing implementation at medical facilities, prone to errors. It is recommended that attention be paid to promptly overcoming the limitations in bidding under the authority of the Ministry.

In 2024, the National Assembly issued Law No. 57/2024/QH15 amending and supplementing the Law on Bidding; then, the Government issued Decree No. 17/2025/ND-CP dated February 6, 2025 amending and supplementing a number of articles of the Decrees detailing a number of articles and measures to implement the Law on Bidding and the Ministry of Planning and Investment (now the Ministry of Finance ) issued circulars guiding the implementation of online bidding. Most recently, on June 25, 2025, the National Assembly also passed Law No. 90/2025/QH15 amending and supplementing a number of laws, including the Law on Bidding.

The above mentioned legal documents on bidding have basically resolved the difficulties and problems in contractor selection activities, especially in the health sector. The regulations on bidding designation, direct procurement, and competitive bidding will help hospitals to immediately purchase drugs and medical equipment for medical examination and treatment without having to go through the bidding process.

In addition, Law No. 90/2025/QH15 has provided for complete decentralization for public service units in deciding on procurement activities. Accordingly, from July 1, 2025, hospitals with autonomy in regular expenditures (autonomy group 2), autonomy in investment expenditures, and regular expenditures (autonomy group 1) can decide on the procurement of drugs and medical equipment from hospital revenues, health insurance expenditures, and other non-state budget sources without having to bid according to the provisions of the Bidding Law.

In addition, the Government has just issued Decree No. 188/2025/ND-CP dated July 1, 2025 to guide the implementation of the Law on Health Insurance, which includes provisions allowing the transfer of drugs between medical facilities and regulations that hospitals are allowed to directly pay for the cost of purchasing drugs and medical supplies for patients in cases where patients have to purchase them themselves.

Currently, the Government is considering and issuing a Decree guiding the implementation of the Law on Bidding to replace Decree No. 24/2024/ND-CP and Decree No. 17/2025/ND-CP; the Ministry of Finance will also issue circulars guiding online bidding. Based on the Government's Decree and the Circular of the Ministry of Finance, the Ministry of Health will review and amend Circular No. 07/2024/TT-BYT on drug bidding to be consistent with the new provisions of the Law on Bidding and the guiding Decree.

In fact, since May 2025, the Ministry of Health has also proactively sent documents to the Departments of Health, hospitals, business associations, etc. requesting to review, comment and propose amendments to Circular No. 07 to make it more suitable for the practice of bidding at hospitals.

2. Voters request the Ministry of Health to coordinate with relevant agencies to pay attention to the issue of advertising functional foods, especially for the elderly who are being treated in hospitals and cannot distinguish between genuine products, so when they see advertisements and find them interesting, they buy them for self-treatment. This is very harmful to the health of patients and affects the treatment work of hospitals.

To improve the effectiveness of food safety management and resolve the above issues, the Ministry of Health and related ministries and sectors have been implementing many synchronous solutions. Specifically:

Regarding strengthening inspection, examination and supervision: Every year, the Ministry of Health - Standing Committee of the Central Interdisciplinary Steering Committee on Food Safety develops and issues a post-inspection plan for food production and trading establishments. The Ministry of Health has issued 8 documents directing localities to strengthen the fight against counterfeit drugs, fake milk and fake health protection foods from the beginning of 2025.

At the same time, a peak period will be launched in May 2025 to combat counterfeit medicines, fake milk and fake health foods, and to strictly punish violations. The Food Safety Department (Ministry of Health) has established 5 surprise inspection teams in the provinces to control the production, export, import and trading of food ingredients, milk and health foods.

Regarding the control of advertising of health protection foods and medicines: The Ministry of Health has strengthened management and strictly punished acts of false advertising, especially on social networks. The Department of Food Safety (Ministry of Health) has been coordinating with the Department of Radio, Television and Electronic Information (Ministry of Culture, Sports and Tourism) to handle administrative violations in advertising food and milk for many famous individuals.

The Ministry of Culture, Sports and Tourism is studying and proposing to increase fines, temporarily suspend advertising activities for serious violations and widely publicize the handling results to warn and deter; request cross-border social networking platforms to block content, block violating accounts and deploy technological solutions to strictly censor advertising content.

In addition, the Ministry of Health and related ministries and sectors are also implementing solutions on applying information technology in food safety management; perfecting the legal system and strengthening sanctions; actively coordinating with other sectors and assigning responsibilities; enhancing information, communication and raising public awareness... to protect people's health and rights.
