Legal determination from the case of "internet gangster" Phu Le gambling clip

(NLDO) - Gambling is an act that endangers society, violates public security and is the cause of other social evils.


As reported by Nguoi Lao Dong Newspaper, Hanoi City Police are verifying a clip on social media showing a gambling scene involving Le Van Phu (aka Phu Le, 45 years old, from Yen Bai ) and several other people.

Accordingly, Phu Le and a group of men and women gambled in the form of "xoc bau cua". In the clip, Phu Le was sitting in charge of the gambling with bowls, plates, 3 dice with 6 sides, and paper divided into 6 boxes with 6 drawings of gourds, shrimp, crabs, fish, deer, and chickens. The clip also shows some objects that look like money.

Lawyer Tran Thi Thanh Thao, Director of Thao Tran Law Firm LLC, said that gambling is the act of participating in illegally organized games where winning (or losing) is accompanied by gaining (or losing) significant material benefits such as money, objects or other forms of property.

This is an act that endangers society, violates public security and is the cause of other social evils. Therefore, all acts such as betting, gambling, winning or losing with money or in kind are always strictly prohibited by law.

According to regulations, those who commit illegal gambling must be subject to legal sanctions regardless of the reason or who the player is. If all elements of the crime of gambling are met, criminal liability will be prosecuted according to the provisions of Article 321 of the current Penal Code.

In cases of illegal gambling that have not yet reached the level of criminal prosecution, the person committing the illegal gambling act will be administratively sanctioned for each illegal gambling, according to the provisions of Article 28 of Decree No. 144/2021/ND-CP.

In addition, violators are also subject to additional penalties such as confiscation of exhibits and means of administrative violation; confiscation of illegal gambling money.

Accordingly, Hanoi City Police will verify to determine how much money, how things happened... From there, they will give an appropriate fine.

Phu Le (real name Le Van Phu, born in 1980, from Yen Bai), is known as a phenomenon that emerged thanks to social networks, having participated in a number of music videos or short films about gangsters with many violent scenes.

In August 2020, "internet gangster" Phu Le was arrested by the police to investigate the act of intentionally causing injury due to his involvement in the assault of two elderly women in Dan Phuong district, Hanoi. However, because the victim's family withdrew the request for prosecution, the People's Court of Dan Phuong district issued a decision to suspend the case and release Phu Le and his two "juniors".
