Faced with the reality of violations, disputes, and complaints in land management and use, affecting security and order, and socio -economic development, the Standing Committee of Tien Du District Party Committee has established a Steering Committee to handle cases of unauthorized land allocation, encroachment, and unauthorized change of land use purpose.
The district has established a Steering Committee Support Team, assigned the Department of Natural Resources and Environment as the standing agency to promptly advise the Steering Committee to urge, guide, review and classify each specific case and time of violation. At the same time, focus on handling and removing difficulties and obstacles in the implementation process and prepare records of cases that meet the conditions to request competent authorities to consider, appraise and issue Certificates according to regulations.
In addition, in cases where land was allocated without proper authority and has been used stably before October 15, 1993, is not in dispute, is in accordance with planning and has fulfilled financial obligations as prescribed, the land user shall be granted a Certificate of land use rights, house ownership rights and other assets attached to the land. In cases where land was allocated without proper authority from July 1, 2004 to before July 1, 2014, the responsibility of the relevant collectives and individuals in the allocation of land without proper authority shall be clarified and handled according to the provisions of law and the issuance of Certificates shall be considered and decided to be granted to cases that meet the conditions as prescribed.
In order to effectively implement the directives and conclusions of the Provincial Party Committee Standing Committee on "Strengthening the Party's leadership in land management in the province" on handling cases of unauthorized land allocation, encroachment, and arbitrary change of land use purposes. The District People's Committee directed communes and towns to strengthen propaganda and mobilize people to voluntarily comply with the provisions of the law. However, violations are still complicated. In most localities, many households have illegally built structures on agricultural land and encroached on it.
Recently, the situation of encroachment on public land, illegal construction on agricultural land, and arbitrary change of land use purposes in violation of regulations in Tien Du district has mainly been concentrated in localities such as Phu Lam commune, Hien Van, Lim town, and Viet Doan.
According to statistics in 2022, Tien Du district had 57 households violating illegal construction and misuse of agricultural land. Up to now, the district has handled 100% of violations in the communes.
Mr. Nguyen Cong Ky - Vice Chairman of Tien Du District People's Committee said that the District is focusing on reviewing and counting each specific case of land violations to clarify the responsibilities of relevant collectives and individuals because this is an important legal basis for handling land violations correctly and accurately, ensuring stability of the local situation. In addition, continue to rectify and further strengthen land management in the coming time, promptly handle and prevent new violations of the law on land management and use arising in the locality; pay attention to promptly, reasonably and in accordance with the law on petitions, complaints, denunciations, land disputes and lawsuits under its jurisdiction, limit the situation of mass petitions, going beyond the level, causing social disorder, contributing to creating stability to promote and develop the local socio-economy.
Mr. Ky added that Tien Du district aims to complete the review, declaration and registration of land by the end of 2024; and complete the issuance of land use right certificates for land plots that meet the prescribed conditions by the end of 2025.
