The Minister emphasized that the problem of counterfeit drugs and food is a global problem, with total estimated losses of up to 600 billion USD per year, according to US statistics. In Vietnam, the act of producing counterfeit drugs can be punished with the highest penalty of death, according to Article 194 of the Penal Code, showing the strictness in handling violations.
Acknowledging the fact that fake drugs and fake functional foods still appear on the market, Minister Dao Hong Lan affirmed: “Through the bidding system, all drugs entering hospitals must have clear origins and sources. Therefore, there are no fake drugs in hospitals.”
The Ministry of Health is coordinating with relevant ministries and sectors – especially the National Steering Committee 389, the Ministry of Public Security and the Ministry of Culture, Sports and Tourism – to strengthen inspection, rectify advertising activities and prevent fake drugs and foods.
“We have signed a regulation with the Ministry of Public Security to resolve related issues. This includes the prevention of counterfeit drugs and fake foods. The three prominent cases involving counterfeit drugs in Thanh Hoa, Kera candy of "Hang Du Muc" and fake cosmetics in Dong Nai were all discovered by the Ministry of Health and transferred to the Ministry of Public Security for investigation, clearly demonstrating the ministry's determination in preventing counterfeit drugs and fake foods,” said Minister Dao Hong Lan.
The second issue that Minister Dao Hong Lan also identified as "very painful" is the legal corridor to protect medical staff.
According to the Minister, recently, when drafting the Law on Medical Examination and Treatment (amended), the Ministry of Health included many regulations prohibiting acts of harm to doctors and medical staff performing medical examination and treatment duties. However, in the recent implementation, there have been unfortunate incidents.
The Minister stated: “The recent incidents in Nam Dinh, Phu Tho, and Nghe An are very regrettable. When the incidents occurred, we directly contacted the local authorities to request strict handling, setting an example to discipline other subjects. We also saw that in some cases, when the incidents occurred, there was an agreement not to prosecute criminally. We propose to handle the violations appropriately to ensure deterrence and demonstrate absolute protection for the medical staff."
