At the Ho Chi Minh City socio-economic press conference on the afternoon of October 26, Mr. Pham Duy Han, Deputy Head of the Land Registration Department, Ho Chi Minh City Department of Natural Resources and Environment, said that the Department had sent a report to the Ho Chi Minh City People's Committee on the issue of arbitrary land division, change of land use purpose, and transfer of rights by handwritten documents.

The Department of Natural Resources and Environment will coordinate with the People's Committees of districts, towns, and Thu Duc City to make plans for declaration and review, depending on the characteristics and situation of each locality.

According to Mr. Han, the issuance of certificates is only carried out after the competent authority has handled land violations (for example, imposing fines if any). At the same time, the People's Committees of districts must review planning, ensuring regulations on land division limits as well as infrastructure.

Previously, on October 18, the Ho Chi Minh City People's Committee also announced the conclusion of Mr. Bui Xuan Cuong, Vice Chairman of the City People's Committee, on the records of arbitrary land division, arbitrary change of land use purpose, and transfer of rights by hand.

Accordingly, the law currently stipulates the authority, conditions, and procedures for granting certificates of land use rights, house ownership rights, and other assets attached to land to individual households.

Recently, Ho Chi Minh City has issued more than 1.57 million certificates of land use rights, house ownership rights and other assets attached to land to households and individuals.

However, this work is still facing difficulties and obstacles in cases where people arbitrarily divide plots, arbitrarily change land use purposes, and transfer rights by hand.

That leads to a number of unresolved cases because land laws over many periods have different regulations and require coordination in handling many issues by competent State agencies.

To resolve the above situation and to speed up the progress of granting land use right certificates, the representative of the Ho Chi Minh City People's Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with districts and Thu Duc City to develop a coordination plan and implement it according to regulations.

The City People's Committee noted the need to classify types of documents, determine implementation time, and develop a coordination mechanism between agencies and units in handling related issues. At the same time, infrastructure and planning conditions must also be ensured to prevent the occurrence of subdivision, land division, and illegal construction.

For the group of files that have not been received, the city assigned the Department of Natural Resources and Environment, districts and Thu Duc City to systematize the conditions for granting certificates, have a plan to widely publicize information, request people to comply with regulations; check and handle violations.
