Specifying the Law on Science and Technology in higher education institutions

The workshop was attended by leaders of units under the Ministry of Education and Training , experts, scientists, and lecturers from higher education institutions to develop a Decree amending and supplementing regulations on scientific and technological activities and innovation in higher education institutions.

On December 30, 2022, the Government issued Decree No. 109/2022/ND-CP regulating scientific and technological activities in higher education institutions, applicable to higher education institutions and related organizations and individuals participating in scientific and technological activities in higher education institutions.

After nearly 3 years of implementation, Decree 109/2022/ND-CP is considered by the scientific community to satisfy the thirst for policies to encourage and support the development of science and technology. Among many contents, the Decree has regulated the organization and management of science and technology activities in higher education institutions, creating a "new wind" to promote effective and quality implementation of tasks.

Recently, the Party and the State have had many policies to promote the application and development of science and technology, promote innovation and digital transformation, and proactively and actively participate in the Fourth Industrial Revolution. In particular, higher education institutions will have many impacts and influences from these policies.

Specifically, on December 22, 2024, the Politburo issued Resolution No. 57-NQ/TW on breakthroughs in science, technology, innovation and national digital transformation. The Resolution emphasizes that science, technology, innovation and digital transformation are decisive factors in the development of countries; they are prerequisites and the best opportunities for our country to develop richly and powerfully in the new era - the era of national development.

On that basis, the Government also issued Resolution No. 03/NQ-CP on the Government's Action Program to implement Resolution No. 57-NQ/TW of the Politburo on breakthroughs in science and technology development, innovation and national digital transformation.

The National Assembly issued Resolution No. 193/2025/QH15 on piloting a number of special mechanisms and policies to create breakthroughs in the development of science, technology, innovation and national digital transformation. The Ministry of Education and Training also issued a plan to implement Resolution No. 57-NQ/TW.

Along with that, on June 27, 2025, the National Assembly issued the Law on Science, Technology and Innovation, regulating scientific, technological and innovation activities of agencies, organizations and individuals; policies and measures to ensure the development of science and technology and promote innovation. The Law will take effect from October 1, 2025.

In order for the Law on Science, Technology and Innovation to soon come into practice, the Government is urgently issuing guiding documents and decrees, including the Decree regulating scientific and technological activities in higher education institutions. This is a decree that the Government assigned the Ministry of Education and Training to preside over the development, updating and supplementation.

Emphasizing that the Law on Science and Technology has many new points, closely related to higher education institutions, Deputy Minister Nguyen Van Phuc asked the delegates attending the workshop to contribute their opinions to amend, supplement or issue a new decree to replace the Decree regulating scientific and technological activities in higher education institutions. Inappropriate points need to be reviewed and adjusted, in order to concretize the Law on Science and Technology in higher education institutions.

At the workshop, delegates contributed their opinions to the draft Decree; assessed the current situation and proposed a number of solutions and orientations for technology transfer activities in higher education institutions to create priority technology products in the context of the Fourth Industrial Revolution, providing scientific arguments as a basis for building and advising on building policies for technology transfer activities in higher education institutions.
