According to DSEDA, in the context of Da Nang promoting the attraction of high-quality investment and building a sustainable industrial-technological ecosystem, the situation of illegal factory leasing in industrial parks is alarmingly emerging, threatening transparency, safety and efficiency in the management and use of industrial land.
DSEZA has directed Hoa Khanh Industrial Park to review factory leasing and land use activities of investment enterprises.
DSEZA emphasized that the consequences of illegal leasing are very serious. First of all, it distorts the investment environment, creating unhealthy competition between law-abiding enterprises and those operating outside the control area. At the same time, it causes the state to lose significant budget revenue from land rent, infrastructure fees and technical services.
More importantly, this situation poses a high risk of labor safety and fire and explosion because many rented facilities operate in substandard factories, are not registered for appropriate industries, and do not comply with fire prevention and fighting regulations.
Legally, the Investment Law, Land Law and related regulations do not allow infrastructure investors or land-using enterprises to arbitrarily sublease without approval from competent state agencies. This behavior not only violates the law but also hinders efforts to attract substantial projects with financial and technological capacity, which are being prioritized by the city in the new development phase.
Faced with the above situation, DSEZA said it is urgently reviewing all projects in the industrial park, especially those that are slow to implement, used for the wrong purpose or have signs of illegal sub-leasing. It will strengthen inter-sectoral inspections to promptly detect and handle violations, and require investors to properly implement planning, investment commitments and financial obligations to the State.
DSEZA also closely coordinates with relevant departments to guide and support enterprises in adjusting project objectives if there is a need to change in accordance with legal regulations; strictly handle cases of intentional violations, including land reclamation and project termination. Legal information of land and factories in industrial parks will be transparent so that secondary enterprises can clearly understand and avoid legal risks when renting premises in violation of regulations.
DSEZA recommends that, in order to ensure a safe, transparent and effective investment environment, each enterprise needs to raise awareness of law compliance; absolutely do not rent or use premises of unknown legal origin or without a valid operating license. At the same time, state management agencies need to resolutely handle violations, not allowing the situation of "legalizing" violations to occur.
