District leader appeals decision to resign, what does Hanoi Chairman say?

The fact that Ms. Pham Thi Hoa - Vice Chairman of the People's Committee of Ha Dong District - despite being on leave still signed documents related to the direction of work in the area is receiving special attention from public opinion.

Recently, Ms. Hoa also filed a complaint against the decision of the Hanoi People's Committee to dismiss her from work according to Decree 46 of the Government.

Talking to the press about the incident on the sidelines of the National Assembly , Chairman of the Hanoi People's Committee Tran Sy Thanh explained that on November 1, the city decided to let Ms. Hoa take a leave of absence, but it was not until November 3 that this document was sent to Ha Dong District. Therefore, Ms. Hoa still signed a number of documents during the time she had decided to take a leave of absence.

Regarding Ms. Pham Thi Hoa's complaint about the decision to dismiss her from work, the head of the city government affirmed that this was an issue discussed by the entire standing committee of the city party committee, not decided by one individual.

On November 9, Ms. Hoa filed a complaint to the Hanoi People's Committee, stating that the decision to dismiss her lacked transparency; she had not been met, discussed, or heard about her thoughts and aspirations by any official or organization.

"I have not yet received any comments from the competent authority regarding whether or not I agree with my request. On November 6, I was suddenly notified by the People's Committee of Ha Dong District and given a decision by the People's Committee of Hanoi City on my resignation, without announcement, without giving the decision, without encouraging or recognizing my individual contributions to the common task," Ms. Hoa stated in her complaint.

Regarding this, the Chairman of Hanoi said that the staff in charge of organizing the event had met and discussed with Ms. Hoa before issuing the decision. In addition, the city is also applying the most beneficial regulations and policies for Ms. Hoa.

According to Mr. Tran Sy Thanh, when this officer files a complaint, the City will consider and handle the complaint according to regulations.

Previously, on November 1, the Hanoi People's Committee decided to allow Ms. Pham Thi Hoa, Vice Chairman of the Ha Dong District People's Committee, to resign according to Decree 46 of the Government .

Decree 46 stipulates that civil servants are entitled to severance pay in the following cases: Upon request and with the consent of the competent agency, organization or unit, or due to two consecutive years of failure to complete tasks as prescribed in Clause 3, Article 58 of the Law on Cadres and Civil Servants.

Ms. Pham Thi Hoa said that in her application to the city in early August, she "asked for early retirement" and not "retirement from work" as the city decided. Therefore, Ms. Hoa submitted a complaint against the decision of the Hanoi People's Committee.
