On November 24, the People's Court of Da Nang City tried Le Duc Phap (33 years old, residing in Hoa Phuoc commune, Hoa Vang district, Da Nang city), a former bank employee, for the crime of "Fraudulent appropriation of property".
According to the indictment, in 2020, Phap worked at the Orient Commercial Joint Stock Bank ( OCB ), Da Nang Branch. Taking advantage of his job position when preparing loan applications for customers, Phap repeatedly provided false information to appropriate customers' loans.
Specifically, in December 2020, Ms. Le Thi My L. (residing in Hoa Vang district) went to OCB Bank Branch to apply for a loan of 1.25 billion VND and Phap was the person who assisted in completing the application.
During the application process, Phap informed Ms. L. that he would borrow the account of Ms. Nguyen Thi Quynh A. (residing in Thanh Khe district, Da Nang) to receive money for Ms. L. when the bank disbursed.

On December 30, 2020, OCB Bank Branch disbursed and transferred the entire VND 1.25 billion of Ms. L. to Ms. Nguyen Thi Quynh A's account.
Phap said that Ms. Nguyen Thi Quynh A. gave him all this money to transfer to Ms. L.
However, after receiving the full 1.25 billion VND, Phap only transferred 500 million VND to Ms. L., saying that this was his money that he lent Ms. L. to solve some work. The remaining 750 million VND, Phap appropriated and used to pay off all the debt.
In mid-January 2021, Ms. L. received a notice from OCB Bank Branch to pay the principal and interest periodically, so she went to the bank to find out and found out that the money had been disbursed since December 30, 2020.
Using the same method, the French appropriated 450 million VND from Ms. Nguyen Thi Nguyet Th. (residing in Cam Le district, Da Nang city).
The indictment concluded that from December 30, 2020 to June 8, 2021, Phap took advantage of his job position when preparing loan applications for customers, defrauding and appropriating a total of 1.2 billion VND.
The People's Court of Da Nang City sentenced Le Duc Phap to 12 years in prison for "Fraudulent appropriation of property".
