Circular No. 73/2024 of the Ministry of Public Security regulating the patrol, control and handling of violations of laws on road traffic order and safety by traffic police will take effect from January 1, 2025.
Article 6 of this Circular stipulates the organization of forces to directly patrol and publicly control road traffic routes.
Traffic police checkpoints must be in open areas with no obstructed view.
Specifically, traffic police are authorized to organize forces at a point on the road, at the police station according to the plan issued by the competent authority.
The location of the checkpoint must be a point on the traffic route, the location must be wide, open, not obstructing the view and in accordance with the law on road traffic order and safety, road laws and related laws.
When organizing a control force at a point on a traffic route, the traffic police use equipped cameras to record the control activities of the working group. Control at night must have lighting and ensure adequate lighting.
Next, Article 14 of Circular No. 73/2024 clearly states that when the vehicle to be inspected has stopped in the position as instructed, the traffic police stand in a suitable and safe position and perform the following steps:
Require the driver to take safety measures and get out of the vehicle.
Salute according to the People's Police regulations (except in cases where it is known in advance that the person is committing an act with signs of a crime, committing a crime in flagrante delicto, or is wanted or being searched for).
When contacting violators, traffic police must maintain proper posture, manners, and behavior. Inform the driver of the basis for stopping the vehicle for inspection and control; the content of the control; and request the driver to present relevant documents.

At the end of the inspection, the officer in charge reports to the team leader about the results, notifies the driver and relevant people of the inspection results, violations (if any) and handling measures.
If there is reason to believe that a traffic participant, means of transport, or object contains hidden evidence, means, or documents used to commit an administrative violation, the person, means of transport, or object may be searched in accordance with the provisions of the law on handling administrative violations.
In case of detecting signs of crime, traffic police will follow the provisions of the law on criminal procedure.
