GD&TĐ - Up to now, the decentralization of state management of education and training according to the 2-level local government model has been stipulated in 2 decrees and many circulars.

Delimitation of authority of two-level local government in the field of state management of the Ministry of Education and Training

Decree No. 142/2025/ND-CP dated June 12, 2025, stipulating the division of authority of two-level local authorities in the field of state management of the Ministry of Education and Training.

In Decree No. 142/2025/ND-CP, the Government has reassigned 2/25 tasks under the authority of the district-level People's Committee to the provincial level for implementation and 23/25 tasks under the authority of the district-level People's Committee to the commune level for implementation; to ensure that after the arrangement of administrative units and the organization of the implementation of the two-level local model, it will operate smoothly, without interruption, without legal gaps, with the following specific areas:

Delimitation of authority in the field of preschool education ; delimitation of authority in the field of general education ; delimitation of authority in the field of continuing education ; delimitation of authority for specialized schools;

Delimitation of authority in the field of vocational education; delimitation of some other authorities in the field of education; for the group of delimitation of authority on state management responsibilities.

The content of the Decree has reduced the number of documents and time for administrative procedures to suit the two-level local government organization model.

Decentralization and delegation in the field of state management of the Ministry of Education and Training

Decree No. 143/2025/ND-CP dated June 12, 2025 regulating decentralization and delegation in the field of state management of the Ministry of Education and Training.

Decentralization and delegation of authority in the field of state management of the Ministry of Education and Training in Decree No. 143/2025/ND-CP for 7 tasks under the authority of the Minister of Education and Training to the Chairman of the Provincial People's Committee, including:

Recognize the province as meeting the standards of universal education level 1 and level 2, and eliminating illiteracy level 1 for the province;

Permission to establish preschools and general education facilities by foreign diplomatic missions and intergovernmental international organizations;

Converting preschool and general education facilities proposed to be established by foreign diplomatic missions and intergovernmental international organizations into non-profit facilities;

Approval of joint organization of foreign language proficiency certification exams;

Granting, extending, amending and supplementing decisions permitting the establishment of representative offices of foreign educational organizations and institutions in Vietnam;

Grant, amend, supplement, extend, re-grant, terminate operations, and revoke licenses to establish representative offices of foreign vocational education organizations and institutions in Vietnam;

Assessing the conditions for organizing teaching of ethnic minority languages.

The content of the Decree has reduced the number of documents and time for administrative procedures to suit the two-level local government organization model.

State management of two-level local government with preschool education

Circular No. 09/2025/TT-BGDDT dated June 12, 2025, stipulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities for preschool education.

The Circular establishes the principle of decentralization in accordance with the capacity of each level, ensuring unified management, avoiding overlapping or omission of tasks, and at the same time linking responsibility and resources for implementation.

Many tasks previously performed by the District Department of Education and Training are now assigned to the Commune People's Committee, especially in the management of preschools, nursery groups, and independent kindergarten classes.

The Circular also clearly stipulates the responsibilities of the Department of Education and Training in providing professional guidance, quality control, organizing the implementation of preschool education programs and building a safe educational environment.

This decentralization aims to enhance proactiveness and management efficiency at the grassroots level, meeting the requirements of preschool education development in the new context.

State management of two-level local government with general education

Circular No. 10/2025/TT-BGDDT dated June 12, 2025, stipulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities for general education.

The Circular transfers many tasks from the District Department of Education and Training to the Commune People's Committee, especially in areas such as: issuing transfer certificates to junior high schools, organizing student assessments at all levels, managing and paying scholarship policies, supporting special subjects, and managing extra-curricular teaching and learning activities in the area.

At the same time, the People's Committee at the commune level is also assigned the responsibility of managing all types of general schools in the area, including primary schools, secondary schools, multi-level general schools, and boarding schools for ethnic minorities.

Meanwhile, the Department of Education and Training plays a professional leading role, responsible for guiding the implementation of general education programs, quality control and ensuring professional requirements for educational activities.

This decentralization aims to enhance management efficiency at the grassroots level, reduce intermediate levels and promote the proactive role of commune-level authorities in implementing general education policies.

State management of two-level local government with vocational education and continuing education

Circular No. 11/2025/TT-BGDDT dated June 12, 2025, stipulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities for vocational education and continuing education.

The Circular decentralizes the People's Committees at the commune level to perform a number of tasks such as: directing, organizing, managing and supervising the activities of Community Learning Centers; supporting the organization of literacy classes and continuing education after literacy; paying scholarships and policies for learners at private vocational education institutions in the area.

At the same time, assign the People's Committee at the commune level to manage conditions to ensure educational activities at continuing education facilities and vocational education facilities according to decentralization.

Meanwhile, the provincial Department of Education and Training is responsible for providing professional guidance, organizing quality assessment, inspecting educational institutions, and supervising the implementation of professional regulations.

Decentralization and delegation aim to enhance the initiative, effectiveness and efficiency of state management at the grassroots level, while ensuring suitability with the practical conditions and resources of each locality.

State management of two-level local government in the field of teachers and educational institution managers

Circular No. 12/2025/TT-BGDDT dated June 12, 2025, stipulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities in the field of teachers and educational institution managers.

Accordingly, many tasks previously performed by the District Department of Education and Training are now assigned to the Commune People's Committee.

Specifically, the People's Committee at the commune level is assigned to organize competitions for excellent teachers, excellent homeroom teachers at school level and excellent leaders of Ho Chi Minh Young Pioneer Teams every two years; organize voting for outstanding teachers and outstanding educational institution managers in the locality.

At the same time, the commune level is responsible for organizing the assessment and classification of professional standards for teachers and principals of educational institutions under its management, based on professional guidance from the provincial level.

On the side of the Department of Education and Training, continue to carry out professional tasks of an inter-provincial or provincial nature such as: evaluating and selecting core management staff; organizing competitions for excellent teachers and excellent principals at the provincial level; guiding the implementation of professional standards and title standards according to current regulations.

The Circular also updates previous normative documents in the direction of replacing the phrase "District-level Department of Education and Training" with "Commune-level People's Committee" to be consistent with the current decentralization model.

State management of two-level local government in the field of education

Circular No. 13/2025/TT-BGDDT dated June 12, 2025, stipulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities in the field of education.

According to the Circular, the People's Committees at the commune level are decentralized to perform a number of important administrative tasks such as: granting, re-granting, adjusting, withdrawing and managing junior high school diploma blanks; certifying copies of diplomas and certificates from the original books according to regulations; organizing the storage, exploitation and use of diploma and certificate data locally.

At the same time, the commune level is also responsible for managing, updating and operating information systems, official emails, and electronic information portals serving educational work in the area.

Meanwhile, the provincial Department of Education and Training plays a role in providing professional guidance, inspecting and supervising the implementation of regulations on diploma and certificate management, ensuring the quality and legality of the educational management system at the grassroots level.

The Circular contributes to streamlining administrative procedures, increasing proactiveness and efficiency in implementing state management tasks on education at the grassroots level.

Duties and powers of the Department of Education and Training, the Department of Culture and Social Affairs under the People's Committee at the commune level in the field of education

Circular 15/2025/TT-BGDDT dated July 24, 2025 stipulates the functions, tasks and powers of the Department of Education and Training under the Provincial People's Committee and the Department of Culture and Social Affairs under the Commune People's Committee in the field of education.

The Circular clearly states that the Department of Education and Training is a specialized agency that advises and assists the Provincial People's Committee in state management of preschool, general, vocational, continuing and university education (if any), with the main tasks including: developing and submitting policies and plans for educational development; managing finances and assets; organizing the apparatus and teaching staff; managing quality and educational programs; directing exams, diplomas, and enrollment; inspecting, examining, resolving complaints and denunciations and implementing digital transformation.

The Commune-level Department of Culture and Society has the function of advising and assisting the Commune People's Committee in managing preschool, primary, secondary and community learning centers; implementing plans, universalizing and eliminating illiteracy; managing educational facilities and personnel; coordinating financial management, facilities and applying information technology.

The Circular also replaces Circular 12/2020/TT-BGDDT and supplements and adjusts a number of contents related to decentralization and delegation in education management.
