69 years ago, on October 10, 1954, tens of thousands of Hanoians burst into joy to welcome the victorious army back, liberating the capital.

According to the Labor Code, workers are not allowed to take time off on Capital Liberation Day, October 10.

Since then, October 10 has become a major event, marking the victorious end of the arduous, sacrificial but heroic and glorious resistance war against the French of the people of the capital in particular and the whole country in general.

According to Article 112 of the 2019 Labor Code, from 2021, employees are entitled to 11 holidays and Tet holidays per year and receive full salary according to the labor contract.

Specifically, employees are entitled to 6 holidays off, including: 1 day of New Year's Day, 5 days of Lunar New Year, 1 day of Hung King's Commemoration Day (10/3 lunar calendar); 1 day of Victory Day (30/4 lunar calendar); 1 day of International Labor Day (1/5); 2 days off for National Day (2/9 and 1 day immediately before or after 2/9).

If these holidays coincide with weekly holidays, employees will be compensated with the following day off. Every year, based on actual conditions, the Prime Minister decides on specific holidays according to regulations.

Thus, Capital Liberation Day, October 10, is not a public holiday according to regulations. Furthermore, in 2023, October 10 does not coincide with a weekend but falls on a Wednesday, so workers will not have a day off.

However, according to the agreement between the employer and the employee, this may be an unpaid day off according to Article 115 of the Labor Code.
