The Law amending and supplementing the Penal Code takes effect from July 1.
Change to life imprisonment for death row inmates
Regarding the transitional provisions, the Law stipulates that death sentences imposed before July 1 for those who committed the above 8 crimes but have not yet been executed will not be executed and the Chief Justice of the Supreme People's Court will decide to convert the death penalty to life imprisonment.
The National Assembly assigned the Supreme People's Court to preside over and coordinate with the Ministry of Public Security, the Ministry of National Defense, the Supreme People's Procuracy and relevant agencies to review death row inmates in this category to implement the new regulations.
Minister of Justice Nguyen Hai Ninh said one of the grounds for abolishing the death penalty for the eight crimes above is that it has not been applied in practice in the past. The abolition of the death penalty for these crimes also serves international cooperation activities, especially in the context of Vietnam promoting increasingly strong relations and mutual trust.
As for the crimes of Embezzlement and Bribery, after abolishing the death penalty, in order to ensure the recovery of assets and encourage offenders to actively report, the law stipulates that people sentenced to life imprisonment can only be considered for a reduction in the term of serving the sentence if they actively return at least 3/4 of the embezzled or bribed assets and actively cooperate with the authorities.
Additional crime of illegal use of drugs
The Law amending the Penal Code adds the crime of Illegal use of narcotics (Article 256a) in the direction of only dealing with those who are in the process of drug addiction treatment or have just finished drug addiction treatment but continue to illegally use narcotics.
The drafting agency believes that drugs are one of the common causes leading to other types of crimes such as theft, fraud, extortion, and robbery. Therefore, stricter criminal policies should be applied to reduce drug demand and stop the supply-demand relationship. This policy is also appropriate in the context of the increasing number of drug addicts.
In addition, the Government believes that drug addiction is becoming younger. A segment of young people are easily enticed and enticed into illegal drug use, turning to drugs to relieve the pressures of life. If there are no effective measures to "reduce demand", the risk of affecting the quality of the labor force and the race is a pressing issue that is being raised.
Increase prison sentences and fines for some crimes

The government said that the increase in the above penalty level is in line with the requirements of fighting crime at present and in the following years. This penalty level takes into account factors such as price fluctuations and per capita income (the basic salary increased 2.04 times, per capita income increased 2.02 times) from 2015 to the present.
