The Ministry of Health has just sent a document to the Ministries of National Defense, Public Security, Home Affairs, Finance, Education and Training, Culture, Sports and Tourism, Agriculture and Environment, Ethnicity and Religion; Government Cipher Committee; People's Committees of provinces and centrally run cities on the implementation of Decree No. 188/2025/ND-CP of the Government detailing and guiding the implementation of a number of articles of the Law on Health Insurance.
Previously, on July 1, 2025, the Government issued Decree No. 188/2025/ND-CP detailing and guiding the implementation of a number of articles of the Law on Health Insurance.
To ensure the implementation of the Decree is synchronous, serious and effective, the Ministry of Health requests that the Ministries and Boards take responsibility for performing the assigned tasks in Article 71 of Decree No. 188/2025/ND-CP and other contents regulating the responsibilities of the Ministries and Boards stated in Decree No. 188/2025/ND-CP.
The Ministry of Health requests that the People's Committees of provinces and centrally-run cities proactively implement the assigned responsibilities in Clause 10, Article 71 of Decree No. 188/2025/ND-CP and other contents regulating the responsibilities of the provincial People's Committees stated in the Decree.
At the same time, direct the Department of Health to coordinate with the Social Insurance agencies of provinces and centrally-run cities and related units to advise the Provincial People's Committee to organize the implementation of state management tasks on health insurance in the area; organize propaganda, training, and dissemination of the contents of Decree No. 188/2025/ND-CP for medical examination and treatment facilities, related organizations and individuals to know and implement.
Urge medical examination and treatment facilities in the area to closely coordinate with the Social Insurance agency in organizing the implementation of Decree No. 188/2025/ND-CP. In case of difficulties or problems, please summarize and report to the Department of Health for timely coordination, consideration and handling according to authority, ensuring smooth medical examination and treatment activities under health insurance, without affecting the rights of patients.
Proactively inspect, monitor the progress and evaluate the results of the implementation of Decree No. 188/2025/ND-CP in localities; promptly report to the People's Committees of provinces and centrally-run cities and the Ministry of Health on difficulties, obstacles and new issues arising in the implementation of the Decree for consideration and appropriate adjustment.

According to the Ministry of Health, Decree 188/2025/ND-CP clearly demonstrates the spirit of administrative reform and governance innovation according to Resolution 66 (innovation in law making and enforcement) and promotes comprehensive digital transformation in the organization and implementation of health insurance policies, a step to concretize Resolution 57 in the health sector.
Decree No. 188/2025/ND-CP is a concrete result of the process of synchronous institutionalization of major policies of the Party, contributing to perfecting the legal system on health insurance in a synchronous, feasible, transparent and practical manner.
At the same time, promoting administrative procedure reform, digitizing processes, and connecting data to serve health insurance payments not only helps reduce the burden on people, but also affirms the central role of digital transformation in developing a modern, effective, and sustainable health system.
Decree No. 188/2025/ND-CP has 12 new points, specifically: Adding cases that are not considered as evasion of health insurance payment; adding regulations on the level of health insurance payment support for some subjects; amending and supplementing the responsibilities of the agency implementing the transfer of health insurance payment funds and the agency making the list of health insurance card issuance for groups of subjects participating in health insurance; adding regulations on health insurance card issuance procedures; adding regulations on health insurance medical examination and treatment contracts; amending and supplementing a number of regulations on payment of medical examination and treatment costs between social insurance agencies and medical examination and treatment facilities.
Supplementing regulations on direct payment to health insurance participants; amending and supplementing regulations on adjusting the rate of expenditure for health insurance examination and treatment, reserve expenditure and organization of health insurance activities from health insurance contributions; amending and supplementing regulations on making revenue and expenditure estimates, notifying expected expenditures and finalizing revenue and expenditure of health insurance funds; supplementing regulations on the responsibilities of agencies and units regarding the application of information technology and digital transformation in the implementation of health insurance; amending and supplementing the responsibilities of agencies and units in organizing implementation.
Stipulate transitional provisions during the implementation phase of arrangement, reorganization, and merger when implementing the arrangement of the two-level local government apparatus.
