Focus on removing difficulties of administrative judgments that have come into legal effect

On the morning of December 26, the Provincial People's Committee held a meeting to direct the enforcement of administrative judgments in the province, chaired by Vice Chairman of the Provincial People's Committee Vo Van Canh.

In 2023, the provincial People's Committee has paid attention to the enforcement of administrative judgments (AJC) in the province, directing units and localities to implement. Typically, it has issued documents urging the enforcement of administrative judgments that have come into legal effect according to the request, recommendation, direction, urging, and handling of responsibilities in AJC of civil judgment enforcement agencies; documents implementing the decision to force AJC of the People's Court of first instance; documents urging the enforcement of administrative judgments that have come into effect.

Vice Chairman of the Provincial People's Committee Vo Van Canh chaired the meeting.

Pursuant to Inspection Conclusion No. 499/BTP-ĐKTLN, dated February 17, 2023 of the Interdisciplinary Inspection Team ( Ministry of Justice ), the Provincial People's Committee has directed agencies and units to base on the content of the inspection team's conclusion to focus on organizing the complete enforcement of administrative judgments and decisions that have come into effect.

At the same time, establish a Working Group to advise the Chairman of the Provincial People's Committee to carry out the responsibilities of the head of the direct superior agency in THAHC (Working Group 10); issue an action plan to assign responsibilities to each member of Working Group 10 to advise on the final execution of pending judgments...

Representatives of the Provincial Department of Natural Resources and Environment contributed comments at the meeting.

In 2023 (from October 1, 2022 to December 25, 2023), the total number of judgments and decisions on administrative cases that need to be monitored is 181 judgments (54 judgments transferred from the previous period, the number of newly accepted judgments is 127 judgments). Of these, 77 judgments have been executed; 104 judgments are being monitored for transfer to the next period.

Regarding the content of Inspection Conclusion No. 499/BTP-ĐKTLN, dated February 17, 2023, there are still 42 administrative judgments that have not been fully executed in the province (39 judgments under the enforcement responsibility of the People's Committees and Chairmen of People's Committees at all levels and 3 judgments under the enforcement responsibility of other agencies. Up to now, the People's Committees and Chairmen of People's Committees at all levels have organized the execution of 26 judgments, while 16 judgments have not been fully executed.

Delegates attending the meeting also frankly pointed out the shortcomings and limitations, such as: the awareness of responsibility in administrative enforcement work of heads of administrative agencies is not high and not at the right level; most of the unenforced judgments are in the land sector, so they are very complicated; there are still different views on the practical application of the law in administrative disputes; the provisions of the law on land still have many shortcomings and overlaps...

Concluding the meeting, Vice Chairman of the Provincial People's Committee Vo Van Canh requested departments, branches and units to strengthen and coordinate to focus on removing difficulties of administrative judgments that have come into legal effect; urge and remind units to enforce; consolidate, perfect and assign tasks according to each specific judgment to members of Working Group 10.

In the immediate future, it is necessary to focus on removing and implementing the resolution of 16 unenforced judgments according to the content of Inspection Conclusion No. 499/BTP-ĐKTLN, dated February 17, 2023 of the Interdisciplinary Inspection Team; inviting units that must enforce judgments related to the content of Inspection Conclusion No. 499 to hold meetings to contribute ideas, opinions, and remove difficulties in implementing pending judgments...
