Meanwhile, the demand for copyright protection in the country is increasing, with Ho Chi Minh City alone having thousands of members of professional associations (fine arts, photography, music , cinema...) and freelance creative practitioners.

Not only do they lack tools, but digital art creators are also confused and unfamiliar with creating a “digital birth certificate” to protect their work. Only when there is a “collision”, such as discovering plagiarism or copyright-related legal disputes, do those involved care about protecting their intellectual property…

This is also the most obvious weakness, causing copyright respect to not be respected and the professional art market to not be able to form a systematic and fundamental step.

The story of artist Teo Pham is a typical example when his digital work posted on his personal page was copied, encoded as NFT and successfully sold for nearly 1,000 USD. It is worth mentioning that the lawsuit has not gone anywhere, the thief himself was stolen by another account, encoded and sold again, making it very difficult to track down and remove the violation.

In addition, the trend of applying AI to the creative practice process is becoming more and more popular, but the big question remains unanswered: will technology only stop at suggesting ideas, or will it be implemented to every detail; are products created by AI considered art; does copyright belong to the creator of the command or to the AI?…

Cultural industry is identified as an important development target of Vietnam and many countries. Before calculating the specific contribution to the economy , the first thing to consider is how to build a professional and systematic creative environment, gradually forming a market with the rule of law... and the core issue for all solutions is still people.

Copyright is not just a right, but first of all it needs to be understood correctly and fully, especially in the context of many intertwined legal issues like today. In addition, tools for this issue also need to be constantly updated to be transparent and suitable for new creative trends. It not only helps creative practitioners to easily apply, but also brings confidence to creators as well as beneficiaries.
